GENERAL TERMS
SCOPE
The website www.aayatcashmere.com, operated by TIMEOS S.à r.l. (8 Avenue Porte neuve, L-2227 Luxembourg, RCS B114047, VAT LU 211 62 471), is intended for retail sales to adult consumers acting in a personal capacity. Any order constitutes unconditional acceptance of the Terms and Conditions of Sale in force on the date of the order; TIMEOS may amend them at any time.
WEBSITE & ACCOUNT
The website is accessible 24/7 except in the event of maintenance or force majeure, without any guarantee of being error-free or uninterrupted. All orders require an account; the Customer guarantees the accuracy of their information and delivery address. TIMEOS may delete an account at any time.
PRODUCTS & AVAILABILITY
Products are sold subject to availability and while stocks last. Photos and descriptions are provided for information purposes only (colours may vary slightly). In the event of an error or an out-of-stock product, TIMEOS may cancel the order, with no liability beyond reimbursement of the amount paid.
ORDERS
An order is validated by clicking “I have read and accept the Terms and Conditions of Sale”. The Customer declares that they are over 18 years of age and the holder of the payment method used. A confirmation email will be sent; invoices are available under “My Account”. TIMEOS may refuse or cancel an order in the event of a payment dispute, suspected fraud, non-compliance with these Terms and Conditions, or purchases made for professional purposes (abnormally large quantities).
PRICES
Prices are in euros, inclusive of VAT, with Luxembourg VAT (17%) applied by default, excluding delivery charges. Within the EU, the VAT rate applicable in the country of delivery applies; outside the EU, products are sold exclusive of VAT. Customs duties and local taxes are the responsibility of the Customer. The applicable price is the price in force at the time the order is placed; TIMEOS may cancel an order in the event of a pricing error.
PAYMENT
Payment is made in full by PayPal or by credit/debit card (Visa, Mastercard, American Express) via Stripe; TIMEOS does not have access to payment details. Orders are shipped only after approval by the card issuer or payment provider. Payment in 2 or 3 instalments is available via Alma (purchases between €50 and €3,000, in 10 countries including France, Belgium, Luxembourg, Germany and the Netherlands): customer fees of 0.82% for 2 instalments or 1.65% for 3 instalments.
DELIVERY
Delivery is made by DPD or DHL (Monday to Friday) to a boutique, relay point or the address provided (no hotel addresses or post office boxes), within Zones 1 to 4 (Europe, United Kingdom, Switzerland and United States; other countries upon request at e-shop@aayat.cashmere.com). Delivery charges: Zone 1: €18; Zone 2: €35 to €55; Zones 3 and 4: €63; free delivery within Luxembourg for orders over €350. Orders are dispatched within a maximum of 3 business days and delivered within 2 to 20 business days following dispatch (indicative delivery times). The Customer must inspect the package upon delivery and make any necessary reservations or claims. In the event of a loss confirmed by the carrier, the order will be refunded within 14 days, with no other compensation payable. In-store collection: within 2 business days (orders placed from Friday at 4 p.m. onwards will be available from the following Tuesday).
RIGHT OF WITHDRAWAL & RETURNS
The Customer may withdraw from the purchase without giving any reason within 14 days of receiving the order, by contacting e-shop@aayat.cashmere.com (stating the order number and the items concerned) before returning the goods. Custom-made products, as well as products that have been used, worn, washed, damaged or unsealed, cannot be returned. Items must be returned intact, with their tags and original packaging (cosmetics must be unopened; shoes must be returned with their box). Return shipping costs are borne by the Customer, except in the case of an incorrect or damaged product. Refunds will be made no later than 14 days after notification of the withdrawal, subject to receipt of the returned products, using the original payment method (store credit where payment was made by gift card). Exchanges are made by returning the original item and placing a new order.
WARRANTIES & LIABILITY
Products are covered by the statutory warranty of conformity (Articles L.212-1 et seq. of the Luxembourg Consumer Code) and the statutory warranty against hidden defects (Articles 1641 et seq. of the Civil Code): repair, replacement or refund, as applicable. Products that have been modified or improperly used, as well as apparent defects, are excluded. Unless otherwise required by law, TIMEOS's liability is limited to the purchase price of the product concerned and excludes indirect losses or damages (loss of profits, non-material damages, etc.).
FORCE MAJEURE
Obligations are suspended for the duration of any event of force majeure (strikes, war, epidemics, transport disruptions, government restrictions, etc.). After a period of more than 3 months, either party may terminate the agreement without compensation.
RETENTION OF TITLE AND INTELLECTUAL PROPERTY
TIMEOS retains ownership of the products until full payment has been received. The content of the website is protected by intellectual property rights; any reproduction or professional use is prohibited.
PERSONAL DATA
Customer data is processed in accordance with TIMEOS's Privacy Policy and is only disclosed with the Customer's consent or where permitted by law. Account deletion may be requested by contacting e-shop@aayat.cashmere.com.
APPLICABLE LAW
Luxembourg law applies; the Luxembourg courts shall have non-exclusive jurisdiction. If any provision is deemed unenforceable, the remaining provisions shall remain in full force and effect.
